3. Data processing in the context of the whistleblower system

The information you provide in the context of the whistleblower system will be used for the purposes of reviewing and documenting the messages, for further investigations and, if necessary, for disclosure to state departments (such as the police, public prosecutor’s office or courts, antitrust authorities and other administrative authorities), for example.
If you send your message using our online message form, your data will be forwarded directly to our external ombudsman service (MTG Wirtschaftskanzlei).

We assure anyone offering information that it will be processed confidentially.

The legal basis for the processing of personal data is the justified interest in exposing and preventing grievances and avoiding damage and liability risks which these would entail for our
company pursuant to Art. 6 (1) sentence 1f) GDPR.

Furthermore, the data processing can be based on § 26 (1) of the German Federal Data Protection Act (BDSG) if this serves to expose criminal offences in the employment relationship.
The provision of information using the whistleblower system is voluntary.
In this system we collect all the data that you enter using our online message form or that you tell us or our ombudsman service.

Please note that for legal reasons concerning data protection there may be an obligation in certain cases to inform the person accused about the accusations made against them and about
investigations carried out. This is not the case, however, if the possibility cannot be excluded that disclosing the information to the person accused could affect light being shed on the matter
in question. If the person accused is notified, the identity of the person who reported the information will not be disclosed as far as this is possible from a legal standpoint.

Your personal data will be erased as soon as it is no longer necessary to meet the purpose of the data processing, neither our company nor the ombudsman service has a justified interest in
its storage, or a data retention period prescribed by law, and particularly the statutory obligation to preserve records, has expired.

4. Your rights

You have the right of access, rectification, erasure, restriction of processing, and, in certain cases, the right to data portability.

Furthermore, you have the right to object at any time, on grounds relating to your particular situation, to your personal data being processed due to a justified or public interest.

You can communicate your objection informally by telephone, by email, by fax if necessary or by sending it to the postal address given at the beginning of this Data Privacy Statement.

If our Data Protection Officer is not able to respond to your concerns to your satisfaction or if you are of the opinion that the processing of the personal data concerning you violates the General Data Protection Regulations, you have the right to complain to a supervisory authority in each case, and particularly in the Member State where you are living or staying, where you work, or where the alleged violation took place.
